By accessing or using the Boumrak platform, website, mobile application, or any associated services (collectively, the "Service"), you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must immediately cease use of the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Boumrak ("Company," "we," "us," or "our"). Your continued use of the Service following the posting of any changes to these Terms constitutes your acceptance of those changes.

You represent that you are at least 18 years of age, or the age of legal majority in your jurisdiction, and that you have the legal capacity to enter into binding contracts. If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

To access certain features of the Service, you must register and create an account. When creating your account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for updating it promptly if it changes.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree not to share your credentials with any third party and to notify Boumrak immediately upon becoming aware of any unauthorized use of your account or any other security breach.

Boumrak will not be liable for any loss or damage arising from your failure to comply with these security obligations. You may be held liable for losses incurred by Boumrak or other users due to unauthorized use of your account resulting from your failure to safeguard your credentials.

• Account credentials must not be shared, sold, or transferred to any third party under any circumstances.
• You must use a strong, unique password and update it periodically to minimize security risks.
• You must enable two-factor authentication where available and offered by the platform.
• Suspicious login activity must be reported to our security team within 24 hours of detection.
• Boumrak reserves the right to suspend or terminate any account suspected of unauthorized access or abuse.

Subject to your compliance with these Terms, Boumrak grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for lawful personal or internal business purposes as permitted by these Terms and applicable law.

You agree not to engage in any of the following prohibited activities in connection with your use of the Service:

• Violating any applicable local, national, or international laws, regulations, or ordinances.
• Circumventing, disabling, or interfering with security-related features of the Service.
• Using automated scripts, bots, scrapers, or similar tools to access or collect data from the Service without prior written consent.
• Transmitting unsolicited commercial communications, spam, or any content that infringes on third-party rights.
• Uploading or transmitting viruses, malware, ransomware, or any other malicious code.
• Attempting to gain unauthorized access to any portion of the Service, other accounts, or computer systems connected to the Service.
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of any component of the Service.
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
• Engaging in any activity that could damage, disable, overburden, or impair the Service or interfere with any other party's use.

The Service and all its contents, features, and functionality — including but not limited to all information, software, text, displays, images, video, audio, design, selection, and arrangement — are owned by Boumrak, its licensors, or other providers of such material and are protected by applicable intellectual property laws.

These Terms permit you to use the Service for your personal, non-commercial use only, or for legitimate internal business purposes. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.

The Boumrak name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Boumrak. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Service are the trademarks of their respective owners.

If you submit, upload, post, or otherwise transmit to the Service any content including reviews, comments, suggestions, ideas, feedback, or other submissions ("User Content"), you grant Boumrak a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable license to use, copy, modify, adapt, publish, translate, distribute, and display such User Content in any medium or format.

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your payment instrument details, billing address, and delivery information.

All payments are processed through secure third-party payment processors. Boumrak does not store complete credit card numbers on its servers. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and authorize Boumrak to charge the applicable fees.

All prices are displayed in the currency applicable to your region. Boumrak reserves the right to change its prices at any time. Price changes will be communicated to you in advance via email or in-app notification. Continued use of the Service after a price change constitutes your agreement to the new pricing.

Subscription services will auto-renew at the end of each billing period unless cancelled prior to the renewal date. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period; no partial refunds are issued for unused portions of the billing period unless mandated by law.

The Service may allow users to post, submit, publish, display, or transmit content to other users or third parties. All User Content must comply with these Terms and our Community Standards. You are solely responsible for any User Content you submit and the consequences of doing so.

You represent and warrant that your User Content does not and will not violate any applicable law, infringe any intellectual property or other proprietary rights of any person, contain defamatory, obscene, abusive, hateful, or otherwise objectionable material, or otherwise violate these Terms.

Boumrak reserves the right, but not the obligation, to review, monitor, moderate, edit, or remove any User Content at our sole discretion and at any time without notice. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.

• Content that is unlawful, fraudulent, threatening, abusive, harassing, or defamatory is strictly prohibited.
• Content that infringes on third-party intellectual property rights will be removed pursuant to our takedown procedure.
• Coordinated inauthentic behavior, including the use of fake accounts to manipulate engagement, is prohibited.
• Misinformation campaigns or content designed to deceive other users will result in account termination.

Your privacy is critically important to us. The collection, use, and sharing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

We process your personal data in compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable, and the data protection laws of the United Kingdom. You have rights regarding your personal data, including the right to access, rectify, erase, restrict processing, and data portability.

Boumrak implements technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

The Service may contain links to or integrations with third-party websites, services, applications, or resources that are not owned or controlled by Boumrak. These links are provided for your convenience only and do not constitute an endorsement or recommendation by Boumrak of the third-party site or its content.

Boumrak has no control over, and assumes no responsibility for, the content, privacy policies, security practices, or service levels of any third-party websites or services. You acknowledge and agree that Boumrak shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your use of or reliance on any such content, goods, or services available through any third-party websites or services.

When you interact with third-party services through our platform, you do so at your own risk and subject to the terms and conditions of those third-party services. We strongly encourage you to review the privacy policy and terms of any third-party service you access through the Service.

Certain features of the Service may rely on third-party APIs, SDKs, or service providers. The availability of such features is subject to the continued availability and functionality of those third-party services. Boumrak is not liable for any downtime, data loss, or service degradation caused by third-party provider failures.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOUMRAK EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

Boumrak does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Boumrak does not warrant that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

Boumrak does not warrant or make any representations regarding the use or results of the use of the Service in terms of correctness, accuracy, reliability, or otherwise. You assume the entire cost of all necessary maintenance, repair, or correction of software or equipment you use in connection with the Service.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOUMRAK, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.

This includes, without limitation, damages for loss of profits, revenue, data, goodwill, use, or other intangible losses, resulting from: (i) your access to, use of, or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, Boumrak's liability shall be limited to the greatest extent permitted by law. In no event shall Boumrak's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you paid to Boumrak in the twelve (12) months immediately preceding the claim.

The limitations of damages set forth above are fundamental elements of the basis of the bargain between Boumrak and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

You agree to defend, indemnify, and hold harmless Boumrak, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees).

This indemnification obligation applies to claims arising out of or relating to your violation of these Terms, your use of the Service, your User Content, your violation of any third-party right including intellectual property or privacy rights, or your violation of any applicable law, rule, or regulation.

Boumrak reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any such claim without our prior written consent.

Boumrak may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to if you breach these Terms, engage in fraudulent or illegal activity, or if we are required to do so by law or regulatory authority.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

You may terminate your account at any time by contacting us at support@boumrak.dz or through the account deletion option in your account settings. Termination of your account does not relieve you of any obligations or liability that arose prior to the date of termination.

• Accounts inactive for more than 24 consecutive months may be subject to deactivation and data deletion.
• Upon account deletion, your personal data will be handled in accordance with our Privacy Policy and data retention schedule.
• Any outstanding financial obligations must be settled prior to account closure.
• Appeals of account suspension decisions must be submitted within 30 days to legal@boumrak.dz.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded from application to these Terms.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be submitted to binding arbitration administered in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall be conducted in English and the seat of arbitration shall be London, United Kingdom.

Each party retains the right to apply to a court of competent jurisdiction for interim or conservatory measures, or for enforcement of any arbitral award. You agree that any dispute resolution proceeding will be conducted on an individual basis and not in a class, consolidated, or representative action.

Boumrak reserves the right to modify, update, or replace these Terms at any time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter.

We will provide notice of material changes through one or more of the following methods: in-app notification, email to your registered address, or a prominent notice on our website. We will indicate the date these Terms were last revised at the top of the page.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service. We encourage you to review these Terms periodically for any changes.

• Material amendments will be communicated at least 14 days before taking effect where required by law.
• Historical versions of these Terms are archived and available on written request within 5 business days.
• Amendments that affect your fundamental rights or obligations require affirmative re-acceptance through in-app prompt.

Boumrak strives to maintain a high level of service availability and reliability. However, the Service may be temporarily unavailable due to scheduled or unscheduled maintenance, system updates, infrastructure upgrades, or events outside our reasonable control. We aim to provide advance notice of scheduled downtime where practicable.

Scheduled maintenance windows will be communicated at least 48 hours in advance through in-app banners, status page updates at status.boumrak.dz, and email notifications to registered users. Emergency maintenance may be carried out without prior notice where required to protect the security or integrity of the Service.

Boumrak targets a monthly uptime of 99.5% for its core platform services, calculated on a rolling 30-day basis, excluding scheduled maintenance windows. Availability targets are aspirational and do not constitute a Service Level Agreement unless separately agreed in writing.

• Service status updates are published in real time at status.boumrak.dz.
• Critical incidents are communicated within 1 hour of detection to affected users.
• Post-incident reports are published within 5 business days for incidents exceeding 2 hours of downtime.
• Planned downtime is scheduled during low-traffic periods wherever technically feasible.
• Users may subscribe to real-time status alerts via email or RSS feed through our status page.

This Acceptable Use Policy sets out the rules and guidelines governing the use of the Boumrak platform. It is incorporated into and forms part of the Terms and Conditions. Any breach of this policy will be treated as a breach of the Terms.

The following categories of activity are expressly prohibited. This list is illustrative and not exhaustive; Boumrak reserves the right to determine, in its sole discretion, whether any use violates this policy.

Boumrak reserves the right to investigate suspected violations of this policy. We may cooperate with law enforcement authorities in the investigation of suspected illegal activity, and may disclose information about you if required by law or to protect the rights or safety of Boumrak or others.

The following table summarizes the data retention periods applicable to different categories of user data processed by Boumrak. These periods are determined by the intersection of operational necessity, contractual obligations, and applicable legal requirements.

At the end of each retention period, data undergoes cryptographic erasure or secure overwrite in compliance with NIST SP 800-88 guidelines. Backup copies are purged within 90 days. For data deletion requests, please contact privacy@boumrak.dz.

The following definitions apply throughout these Terms. Unless the context otherwise requires, words in the singular include the plural and vice versa.

• "Service" means the Boumrak platform, website, mobile applications, APIs, and all associated features and functionality made available by Boumrak.
• "User Content" means any text, images, videos, audio, data, or other material that you submit, upload, post, or transmit to or through the Service.
• "Personal Data" has the meaning given to it under applicable data protection law, including the UK GDPR and the Data Protection Act 2018.
• "Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, database rights, and any other intellectual or industrial property rights, whether registered or unregistered.
• "Confidential Information" means any non-public information disclosed by one party to the other that is designated as confidential or that reasonably should be understood to be confidential.
• "Business Day" means any day other than a Saturday, Sunday, or public holiday in England and Wales.
• "Force Majeure Event" means any event beyond the reasonable control of a party, including acts of God, war, terrorism, strikes, pandemics, or governmental actions.
• "Subscription" means a recurring paid plan granting access to premium features of the Service for a defined billing period.

Headings in these Terms are for convenience only and shall not affect interpretation. If any provision is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force.
